ARRANGEMENT ON COOPERATION BETWEEN THE COOPERATING AGENCIES OF
|
||
THE PARTIES TO THE INTERNATIONAL COSPAS-SARSAT PROGRAMME
|
||
AGREEMENT AND THE EUROPEAN ORGANISATION FOR THE EXPLOITATION OF
|
||
METEOROLOGICAL SATELLITES (EUMETSAT) ON THE EUMETSAT
|
||
CONTRIBUTION TO THE COSPAS-SARSAT GEOSAR SYSTEM
|
||
The Cooperating Agencies of the Parties to the International COSPAS-SARSAT Programme
|
||
Agreement and the European Organisation for the Exploitation of Meteorological Satellites
|
||
(EUMETSAT) hereinafter referred to as the "Signatories",
|
||
NOTING the successful implementation of the COSPAS-SARSAT search and rescue satellite system
|
||
established and operated under the terms of the International COSPAS-SARSAT Programme
|
||
Agreement done at Paris on 1 July 1988,
|
||
NOTING that EUMETSAT was established by the Convention opened for signature in Geneva on 24
|
||
May 1983 and entered into force on 19 June 1986, as amended by the Amending Protocol attached to
|
||
EUMETSAT Council Resolution EUM/C/Res. XXXVI, which entered into force on 19 November
|
||
2000,
|
||
NOTING the long-term operation of the COSPAS-SARSAT System and its significant international
|
||
contribution to the saving of human lives for more than twenty-five years through the use of search
|
||
and rescue instruments on satellites in low Earth orbit and geostationary Earth orbit ,
|
||
NOTING the commitment of the Parties to the International COSPAS-SARSAT Programme
|
||
Agreement to assure the long-term operation of the COSPAS-SARSAT System and access to this
|
||
System to all States on a non-discriminatory basis, and free of charge to the end-user in distress,
|
||
RECALLING that the primary objective of EUMETSAT is to establish, maintain and exploit
|
||
European systems of operational meteorological satellites, taking into account as far as possible the
|
||
recommendations of the World Meteorological Organization, and that a further objective of
|
||
EUMETSAT is to contribute to the operational monitoring of the climate and the detection of global
|
||
climatic changes,
|
||
NOTING that EUMETSAT successfully operates the first and second generation of operational
|
||
geostationary meteorological Meteosat satellites since 1989, and is developing the Meteosat Third
|
||
Generation (MTG) of satellites,
|
||
RECALLING the decision by the EUMETSAT Council at its 31st meeting in 1996 to accommodate
|
||
search and rescue transponders (GEOSAR) onboard the Meteosat Second Generation (MSG) satellites
|
||
MSG-1, -2 and -3,
|
||
RECALLING that the Twenty-Fourth Session of the COSPAS-SARSAT Council in April 2000
|
||
decided to pursue the development of formal relations with EUMETSAT using Articles 9 (Functions
|
||
of the Council) and 13 (Relationship with International Organizations) of the International
|
||
COSPAS-SARSAT Programme Agreement as a basis,
|
||
RECALLING the exchange of letters in June 2001 between EUMETSAT and COSPAS-SARSAT for
|
||
the inclusion of GEOSAR payloads onboard MSG-1, -2 and -3 satellites,
|
||
NOTING the plans of EUMETSAT to embark a GEOSAR payload onboard the MSG-4 satellite and
|
||
MTG imaging satellites,
|
||
NOTING the intent of the Parties to the International COSPAS-SARSAT Programme Agreement to
|
||
maintain the GEOSAR system and the Signatories' desire to formalise in a specific instrument their
|
||
|
||

longstanding cooperation with a view to continuing a GEOSAR mission onboard the EUMETSAT
|
||
MSG-4 and the MTG imaging satellites,
|
||
HAVE COME TO THE FOLLOWING ARRANGEMENT:
|
||
1.
|
||
DEFINITIONS
|
||
For the purpose of this Arrangement:
|
||
-
|
||
"Agreement" means the International COSPAS-SARSAT Programme Agreement, done at
|
||
Paris on 1 July 1988.
|
||
-
|
||
"Arrangement" means the present Arrangement on Cooperation between the Cooperating
|
||
Agencies of the Parties to the International COSPAS-SARSAT Programme Agreement and
|
||
the European Organisation for the Exploitation of Meteorological Satellites on the
|
||
EUMETSAT Contribution to the COSPAS-SARSAT GEOSAR system.
|
||
-
|
||
"Cooperating Agencies" means the organisations designated by the Parties to the
|
||
Agreement for the purpose of implementing the Programme.
|
||
-
|
||
"COSPAS-SARSAT System" means the satellite-aided search and rescue system
|
||
comprising:
|
||
a) the low-altitude Earth-orbiting satellites of the LEOSAR (low-altitude Earth orbit
|
||
satellite system for SAR) space segment described in Article 3 of the Agreement,
|
||
b) the geostationary Earth-orbiting satellites of the GEOSAR space segment as decided by
|
||
the COSPAS-SARSAT Council pursuant to Article 3.2 of the Agreement,
|
||
c) the ground segment established by the Parties to the Agreement or by Ground Segment
|
||
Providers under the terms of the Agreement, including Local User Terminals operating
|
||
with the LEOSAR and GEOSAR satellites and Mission Control Centres, and
|
||
d) radiobeacons operating at 406 MHz as described at Article 3 of the Agreement,
|
||
including the radiobeacons provided by User States under the terms of the Agreement,
|
||
or by other States that avail themselves of the System.
|
||

|
||
"GEOSAR system" means the 406 MHz search and rescue payloads on geostationary
|
||
Earth-orbiting satellite systems, and the ground segment for receiving and processing
|
||
406 MHz radiobeacon transmissions.
|
||
-
|
||
"Interoperability" means that the EUMETSAT GEOSAR payloads comply with
|
||
applicable COSPAS-SARSAT performance standards and allow the ground segment to
|
||
process the relayed 406 MHz beacon transmissions.
|
||
-
|
||
"Meteosat space segment" means the fourth satellite of the EUMETSAT Meteosat Second
|
||
Generation (MSG) and the imaging satellites of the Meteosat Third Generation (MTG)
|
||
series.
|
||
-
|
||
"Participants" means the States and Organisations who have formally notified their
|
||
association with the Programme under the terms of the Agreement.
|
||
-
|
||
"Programme" means those activities carried out by the Parties to the Agreement and other
|
||
States and organisations who have formally notified their association under the terms of the
|
||
Agreement, to provide, operate and co-ordinate the COSPAS-SARSAT System according
|
||
|
||

to the policies, standards and processes detailed in COSPAS-SARSAT System documents
|
||
approved by the COSPAS-SARSAT Council.
|
||
2.
|
||
OBJECTIVE AND SCOPE OF THE ARRANGEMENT
|
||
2.1
|
||
The objective of this Arrangement is to establish the framework for cooperation between the
|
||
Cooperating Agencies of the Parties to the Agreement and EUMETSAT.
|
||
2.2
|
||
The scope of this Arrangement is the provision, launch and operation of 406 MHz GEOSAR
|
||
payloads in the Meteosat space segment and the integration of this Meteosat GEOSAR
|
||
capability into the COSPAS-SARSAT System.
|
||
3.
|
||
PRINCIPLES OF COOPERATION
|
||
3.1
|
||
This Arrangement is not binding under international law and does not require the exchange of
|
||
resources or technology among the Signatories. The Signatories intend to carry out all activities
|
||
under this Arrangement on a reasonable effort basis. The GEOSAR payload should not be a
|
||
priority for the Meteosat space segment and ground segment development, operation and
|
||
schedule.
|
||
3.2
|
||
The Signatories intend to co-ordinate the operation of the Meteosat GEOSAR payloads
|
||
according to principles outlined in a "EUMETSAT to COSPAS-SARSAT GEOSAR Operations
|
||
Interface Control Document" (OICD) established by EUMETSAT in cooperation with
|
||
COSPAS-SARSAT.
|
||
4.
|
||
RADIO FREQUENCY CO-ORDINATION
|
||
4.1
|
||
The Signatories intend to cooperate on the matter of frequency co-ordination of the downlink in
|
||
order to avoid harmful interference to the COSPAS-SARSAT System.
|
||
4.2
|
||
Nothing in this Arrangement is intended to supersede, modify or derogate from regulations,
|
||
recommendations and procedures of the International Telecommunication Union.
|
||
5.
|
||
ROLES AND ACTIVITIES
|
||
5.1
|
||
EUMETSAT intends to provide, accommodate and launch as part of the Meteosat space
|
||
segment GEOSAR payloads which relay the radio transmissions from 406 MHz beacons
|
||
compliant with the requirements of document "COSPAS-SARSAT 406 MHz Beacon
|
||
Specification" (C/S T.001).
|
||
5.2
|
||
EUMETSAT intends to operate the GEOSAR payloads, as part of the overall operation of the
|
||
Meteosat space segment, in accordance with the OICD.
|
||
5.3
|
||
The Cooperating Agencies intend to commission the Meteosat GEOSAR payloads after launch
|
||
by designating a Cooperating Agency to carry out such task, in cooperation with EUMETSAT
|
||
and in accordance with the provisions of the OICD.
|
||
5.4
|
||
The Cooperating agencies intend to provide and operate, directly or through other Programme
|
||
Participants, a GEOSAR ground segment, and they express their preference for a broad-beam
|
||
downlink in the 1544-1545 MHz frequency band.
|
||

5.5
|
||
The Signatories designate the EUMETSAT Programme Manager and the Head of the
|
||
COSPAS-SARSAT Secretariat as the official points of contact on matters concerning this
|
||
Arrangement. The Signatories should designate their operational points of contact in the
|
||
OICD.
|
||
6.
|
||
CO-ORDINATION
|
||
The Signatories intend to co-ordinate their activities under this Arrangement within the
|
||
framework of the Programme, which includes attendance by EUMETSAT in the following
|
||
meetings, where relevant:
|
||
a.
|
||
Open Meetings of COSPAS-SARSAT Council Sessions to address policy and planning
|
||
matters;
|
||
b.
|
||
COSPAS-SARSAT Joint Committee Meetings to address technical and operational
|
||
activities to include the creation, or modification, of specifications and documents
|
||
concerning GEOSAR space and ground segment systems development, and GEOSAR
|
||
system demonstration and evaluation;
|
||
c.
|
||
COSPAS-SARSAT Task Groups established to address specific technical and operational
|
||
matters of joint interest; and
|
||
d.
|
||
COSPAS-SARSAT Experts' Working Groups convened by the COSPAS-SARSAT
|
||
Council as appropriate to address matters of specific interest to the Signatories.
|
||
7.
|
||
FINANCIAL MATTERS
|
||
The Signatories do not intend to exchange funds. The activities of each Signatory pursuant to
|
||
this Arrangement are subject to the availability of appropriated funds.
|
||
8.
|
||
DIFFERENCES IN INTERPRETATION AND IMPLEMENTATION
|
||
The Signatories intend to resolve any differences in the interpretation or implementation of this
|
||
Arrangement through consultations and negotiations.
|
||
9.
|
||
EFFECTIVE DATE, DURATION AND AMENDMENTS
|
||
9.1
|
||
This Arrangement should take effect upon the last signature by the Signatories and should
|
||
remain effective for the duration of the operation of the Meteosat space segment.
|
||
9.2
|
||
The Signatories may extend or amend this Arrangement upon their mutual written consent.
|
||
Signed in six (6) originals in the English, French and Russian languages, each version being equally
|
||
valid.
|

||
SATELLITES MÉTÉOROLOGIQUES (EUMETSAT) CONCERNANT LA CONTRIBUTION
|
||
D'EUMETSAT AU SYSTÈME GEOSAR DE COSPAS-SARSAT
|
||
Les Organismes Coopérateurs des Parties à l'Accord relatif au programme international
|
||
COSPAS-SARSAT et l'Organisation européenne pour l'exploitation des satellites météorologiques
|
||
(EUMETSAT) ci après désignés les « Signataires » :
|
||
CONSTATANT le succès de la mise en œuvre du système COSPAS-SARSAT d'aide aux recherches
|
||
et au sauvetage par satellite établi et exploité selon les termes de l'Accord relatif au programme
|
||
international COSPAS-SARSAT fait à Paris le 1er juillet 1988 ;
|
||
CONSTATANT l'établissement d'EUMETSAT par la Convention ouverte à signature à Genève le 24
|
||
mai 1983 et entrée en vigueur le 19 juin 1986, telle qu'amendée par le protocole d'amendement
|
||
annexé à la résolution du Conseil d'EUMETSAT EUM/C/Res. XXXVI qui est entrée en vigueur le
|
||
19 novembre 2000 ;
|
||
CONSTATANT la continuité de l'exploitation du système COSPAS-SARSAT sur le long terme et
|
||
que, grâce à l'utilisation d'instruments de recherche et de sauvetage sur des satellites en orbite
|
||
terrestre basse et en orbite géostationnaire, la contribution de ce système à la sauvegarde de la vie
|
||
humaine à l'échelle internationale, pendant plus de vingt ans, a été importante ;
|
||
CONSTATANT l'engagement des Parties à l'Accord relatif au programme international
|
||
COSPAS-SARSAT d'assurer l'exploitation à long terme du système COSPAS-SARSAT et l'accès à
|
||
ce système pour tous les États sans discrimination et gratuitement pour l'utilisateur en détresse ;
|
||
RAPPELANT que l'objectif premier d'EUMETSAT est d'établir, de maintenir et d'exploiter des
|
||
systèmes européens de satellites météorologiques opérationnels, prenant en compte autant que
|
||
possible les recommandations de l'Organisation Météorologique Mondiale, et qu'un objectif
|
||
additionnel d'EUMETSAT est de contribuer à la surveillance du climat et à la détection des
|
||
changements climatiques ;
|
||
CONSTATANT qu'EUMETSAT exploite avec succès depuis 1989 les satellites météorologiques
|
||
géostationnaires opérationnels Météosat de première et de seconde génération et développe les
|
||
satellites Météosat de troisième génération (MTG) ;
|
||
RAPPELANT qu'en 1996 à sa trente-et-unième réunion, le Conseil d'EUMETSAT a décidé
|
||
l'installation de transpondeurs pour les recherches et le sauvetage (GEOSAR) sur les satellites
|
||
MSG-1, -2 et -3 du système de seconde génération (MSG) ;
|
||
RAPPELANT qu'en avril 2000 la vingt-quatrième session du Conseil COSPAS-SARSAT a décidé de
|
||
poursuivre le développement de relations formelles avec EUMETSAT sur la base des Articles 9
|
||
(Fonctions du Conseil) et 13 (Relations avec les organisations internationales) de l'Accord relatif au
|
||
programme international COSPAS-SARSAT ;
|
||
RAPPELANT l'échange de lettres en juin 2001 entre EUMETSAT et COSPAS-SARSAT relatif à
|
||
l'intégration des charges utiles GEOSAR sur les satellites MSG-1, -2 et -3 ;
|
||
CONSTATANT qu'EUMETSAT a prévu d'embarquer une charge utile GEOSAR sur le satellite
|
||
MSG-4 et les satellites imageurs MTG ;
|
||

CONSTATANT l'intention des Parties à l'Accord relatif au programme international
|
||
COSPAS-SARSAT de maintenir le système GEOSAR et le souhait des Signataires de formaliser dans
|
||
un instrument spécifique leur coopération de longue date dans la perspective de continuation d'une
|
||
mission GEOSAR à bord du satellite MSG-4 et des satellites imageurs MTG d'EUMETSAT ;
|
||
ONT CONCLU L'ARRANGEMENT SUIVANT :
|
||
1.

||
DÉFINITIONS
|
||
Aux fins du présent Arrangement :
|
||
- Le
|
||

désigne

l'Accord

||

||

|
||
COSPAS-SARSAT fait à Paris le 1er juillet 1988.
|
||
- Le terme « Arrangement » désigne le présent Arrangement de coopération entre les
|
||
organismes coopérateurs des Parties à l'Accord relatif au programme international
|
||
COSPAS-SARSAT et l'Organisation européenne pour l'exploitation des satellites
|
||
météorologiques (EUMETSAT) concernant la contribution d'EUMETSAT au système
|
||
GEOSAR de Cospas-Sarsat
|
||
- Le terme « interopérabilité » signifie que les charges utiles GEOSAR d'EUMETSAT
|
||
satisfont aux normes de fonctionnement applicables de COSPAS-SARSAT et permettent au
|
||
segment sol de traiter les signaux retransmis des balises à 406 MHz.
|
||
- L'expression « Organismes Coopérateurs » désigne les organismes désignés par les Parties à
|
||
l'Accord aux fins de la mise en œuvre du Programme.
|
||

|
||
Le terme « Participants » désigne les États et organisations qui ont formellement notifié leur
|
||
association avec le Programme selon les termes de l'Accord.
|
||
- Le terme « Programme » désigne les activités des Parties à l'Accord et d'autres États et
|
||
organisations qui ont formellement notifié leur association selon les termes de l'Accord pour
|
||
fournir, exploiter et coordonner le système COSPAS-SARSAT conformément aux
|
||
politiques, normes et processus détaillés dans les documents du système COSPAS-SARSAT
|
||
approuvés par le Conseil.
|
||
- Le terme « segment spatial Météosat » désigne le quatrième satellite Météosat de la seconde
|
||
génération (MSG) d'EUMETSAT et la série des satellites imageurs Météosat de troisième
|
||
génération (MTG).
|
||
- Le terme « Système COSPAS-SARSAT » désigne le système de satellites pour les
|
||
recherches et le sauvetage qui comprend:
|
||
a)
|
||
les satellites en orbite terrestre à basse altitude du segment spatial LEOSAR (système
|
||
de satellites sur orbite terrestre basse altitude pour les recherches et le sauvetage) décrit
|
||
à l'Article 3 de l'Accord,
|
||
b)
|
||
les satellites en orbite terrestre géostationnaire du segment spatial GEOSAR tel que
|
||
décidé par le Conseil COSPAS-SARSAT conformément à l'Article 3.2 de l'Accord,
|
||
c)
|
||
le segment sol mis en place par les Parties à l'Accord ou par les Fournisseurs du
|
||
Segment Sol selon les termes de l'Accord, y compris les stations terriennes à utilisation
|
||
locale fonctionnant avec les satellites LEOSAR et GEOSAR et les centres de contrôle
|
||
de mission, et
|
||
d)
|
||
les radiobalises fonctionnant à 406 MHz telles que décrites à l'Article 3 de l'Accord, y
|
||
compris les radiobalises fournies par les États Utilisateurs selon les termes de l'Accord
|
||
ou par d'autres États se prévalant du Système.
|
||

- Le terme « système GEOSAR » désigne les charges utiles à 406 MHz pour les recherches et
|
||
le sauvetage embarquées sur les systèmes de satellites en orbite terrestre géostationnaires et
|
||
le segment sol pour la réception et le traitement des émissions des radiobalises à 406 MHz.
|
||
2.
|
||
OBJECTIF ET PORTÉE DE L'ARRANGEMENT
|
||
2.1
|
||
L'objectif de cet Arrangement est d'établir le cadre de la coopération entre les Organismes
|
||
Coopérateurs des Parties à l'Accord et EUMETSAT.
|
||
2.2
|
||
La portée de cet Arrangement est la fourniture, le lancement et l'exploitation de charges utiles
|
||
GEOSAR à 406 MHz sur le segment spatial Météosat et l'intégration de cette capacité
|
||
GEOSAR de Météosat dans le système COSPAS-SARSAT.
|
||
3.
|
||
PRINCIPES DE LA COOPÉRATION
|
||
3.1
|
||
Cet Arrangement ne lie pas les Signataires au regard du droit international et n'implique pas
|
||
d'échange de moyens ou de technologie entre les Signataires. Les Signataires entendent
|
||
conduire toutes les activités couvertes par cet Arrangement sur la base d'un effort raisonnable.
|
||
Les charges utiles GEOSAR ne sont pas une priorité pour les développements, l'exploitation et
|
||
le calendrier du segment spatial et du segment sol de Météosat.
|
||
3.2
|
||
Les Signataires prévoient de coordonner l'exploitation de la charge utile GEOSAR de Météosat
|
||
conformément aux principes décrits dans le « Document pour le contrôle des interfaces
|
||
EUMETSAT et COSPAS-SARSAT du GEOSAR » (OICD) établi par EUMETSAT en
|
||
coopération avec Cospas-Sarsat.
|
||
4.
|
||
COORDINATION DES FRÉQUENCES RADIO
|
||
4.1
|
||
Les Signataires entendent coopérer en matière de coordination des fréquences de la liaison
|
||
descendante dans le but d'éviter des brouillages préjudiciables au système COSPAS-SARSAT.
|
||
4.2
|
||

||
RÔLES ET ACTIVITÉS
|
||
5.1
|
||
EUMETSAT entend fournir, installer et lancer comme faisant partie du segment spatial
|
||
Météosat des charges utiles GEOSAR qui relaient les émissions radio de balises à 406 MHz
|
||
conformes aux exigences du document « Spécification des balises COSPAS-SARSAT à
|
||
406 MHz » (C/S T.001).
|
||
5.2
|
||
EUMETSAT entend exploiter les charges utiles GEOSAR dans le cadre de la mise en œuvre du
|
||
segment spatial Météosat, conformément au document OICD.
|
||
5.3
|
||
Les Organismes Coopérateurs entendent effectuer la mise en service des charges utiles
|
||
GEOSAR de Météosat après le lancement en désignant un Organisme Coopérateur chargé de
|
||
cette tâche en coopération avec EUMETSAT et conformément aux dispositions du document
|
||
OICD.
|
||
5.4
|
||
Les Organismes Coopérateurs entendent fournir et exploiter, soit directement soit par
|
||
l'intermédiaire des autres Participants au Programme, un segment sol GEOSAR et expriment
|
||

leur préférence pour une liaison descendante à faisceau large dans la bande de fréquence 1544-
|
||
1545 MHz.
|
||
5.5
|
||
Les Signataires désignent le Responsable Programme d'EUMETSAT et le Chef du Secrétariat
|
||
COSPAS-SARSAT comme les points de contact officiels pour toute question relative à cet
|
||
Arrangement. Les Signataires désigneront leurs points de contacts opérationnels dans le
|
||
document OICD.
|
||
6.
|
||
COORDINATION
|
||
Les Signataires entendent coordonner les activités menées au titre du présent Arrangement dans le
|
||
cadre des activités du Programme, ce qui comprend la participation d'EUMETSAT aux réunions
|
||
suivantes, lorsque pertinente :
|
||
a.
|
||
réunions ouvertes des sessions du Conseil COSPAS-SARSAT pour traiter des sujets
|
||
concernant la politique et la planification;
|
||
b.
|
||
réunions du Comité Conjoint COSPAS-SARSAT pour les activités techniques et
|
||
opérationnelles, y compris l'établissement ou la modification des spécifications et
|
||
documents concernant le développement des éléments du segment spatial et du segment
|
||
sol du GEOSAR et la démonstration et l'évaluation du système GEOSAR;
|
||
c.
|
||
les groupes de tâches COSPAS-SARSAT établis pour traiter des questions techniques ou
|
||
opérationnelles spécifiques d'intérêt commun; et
|
||
d.
|
||
les groupes d'experts COSPAS-SARSAT convoqués par le Conseil COSPAS-SARSAT
|
||
selon le besoin pour traiter de sujets d'intérêt spécifique pour les Signataires.
|
||
7.
|
||
QUESTIONS FINANCIÈRES
|
||
Les Signataires n'entendent pas échanger de fonds. Les activités incombant à chacun des
|
||
Signataires au titre de cet Arrangement sont menées sous réserve de la disponibilité des fonds
|
||
appropriés.
|
||
8.
|
||
DIFFÉRENDS RELATIFS À L'INTERPRÉTATION ET À LA MISE EN ŒUVRE
|
||
Les Signataires entendent résoudre tout différend relatif à l'interprétation et à la mise en œuvre
|
||
de cet Arrangement par des consultations et des négociations.
|
||
9.
|
||
DATE D'EFFET, DURÉE ET AMENDEMENTS
|
||
9.1
|
||
Cet Arrangement prend effet à la date de la dernière signature par les Signataires et reste en
|
||
vigueur pour la durée de l'exploitation du segment spatial Météosat.
|
||
9.2
|
||
Les Signataires peuvent prolonger ou amender cet Arrangement par consentement mutuel écrit.
|
||
Six (6) originaux ont été signés en langue anglaise, française et russe, chacune des versions faisant
|

également foi.

ЕВРОПЕЙСКОЙ ОРГАНИЗАЦИЕЙ ПО ЭКСПЛУАТАЦИИ
|
||
МЕТЕОРОЛОГИЧЕСКИХ СПУТНИКОВ (ЕВМЕТСАТ) В ОТНОШЕНИИ
|
||
ВКЛАДА ЕВМЕТСАТ В ГЕОСТАЦИОНАРНУЮ СПУТНИКОВУЮ СИСТЕМУ
|
||
ПОИСКА И СПАСАНИЯ СИСТЕМЫ КОСПАС-САРСАТ
|
||
Сотрудничающие организации Сторон Соглашения о Международной программе КОСПАС-
|
||
САРСАТ и Европейская организация по эксплуатации метеорологических спутников
|
||
(ЕВМЕТСАТ), далее именуемые как Подписавшиеся стороны:
|
||
ОТМЕЧАЯ успешное внедрение спутниковой системы поиска и спасания КОСПАС-САРСАТ,
|
||
учрежденной и эксплуатируемой в рамках Соглашения о Международной программе
|
||
КОСПАС-САРСАТ, совершенного в Париже 1 июля 1988 г.,
|
||
ОТМЕЧАЯ, что ЕВМЕТСАТ был учрежден Конвенцией, открытой для подписания в Женеве
|
||
24 мая 1983 г. и вступившей в силу 19 июня 1986 г., с поправками, внесенными Поправочным
|
||
Протоколом, приложенным к Резолюции Совета ЕВМЕТСАТ EUM/C/Res. XXXVI, которая
|
||
вступила в силу 19 ноября 2000 г.,
|
||
ОТМЕЧАЯ долговременную эксплуатацию Системы КОСПАС-САРСАТ и ее значительный
|
||
вклад в спасение жизней граждан различных государств на протяжении более 25 лет благодаря
|
||
использованию аппаратуры поиска и спасания, установленной на низкоорбитальных и
|
||
геостационарных спутниках,
|
||
ОТМЕЧАЯ обязательство Сторон Соглашения о Международной программе КОСПАС-
|
||
САРСАТ обеспечивать долговременную эксплуатацию Системы КОСПАС-САРСАТ и доступ
|
||
к этой Системе всем государствам на недискриминационной основе и бесплатно для терпящих
|
||
бедствие конечных пользователей,
|
||
ССЫЛАЯСЬ на то, что основополагающей целью ЕВМЕТСАТ является установление,
|
||
поддержание и использование существующих европейских систем метеорологических
|
||
спутников, принимая во внимание, насколько это возможно, рекомендации Всемирной
|
||
метеорологической организации, и что последующей целью ЕВМЕТСАТ является внесение
|
||
вклада в мониторинг климата и обнаружение глобальных климатических изменений,
|
||
ОТМЕЧАЯ, что ЕВМЕТСАТ с 1989 г. успешно эксплуатирует первое и второе поколение
|
||
существующих геостационарных метеорологических спутников "Метеосат" и разрабатывает
|
||
третье поколение спутников "Метеосат",
|
||
ССЫЛАЯСЬ на решение Совета ЕВМЕТСАТ на его 31-м заседании в 1996 г. об установке
|
||
ретрансляторов поиска и спасания геостационарной спутниковой системы поиска и спасания
|
||
(ГССПС) на первом, втором и третьем спутниках "Метеосат" второго поколения,
|
||
ССЫЛАЯСЬ на то, что Совет КОСПАС-САРСАТ на своей 24-й сессии в апреле 2000 г. решил
|
||
развивать официальные отношения с ЕВМЕТСАТ, используя в качестве основы Статьи 9
|
||
(Функции Совета) и 13 (Отношения с международными организациями) Соглашения о
|
||
Международной программе КОСПАС-САРСАТ,
|
||

ССЫЛАЯСЬ на обмен письмами в июне 2001 г. между ЕВМЕТСАТ и КОСПАС-САРСАТ
|
||
относительно установки ретрансляторов ГССПС на первом, втором и третьем спутниках
|
||
"Метеосат" второго поколения,
|
||
ОТМЕЧАЯ планы ЕВМЕТСАТ по установке ретрансляторов ГССПС на четвертом спутнике
|
||
"Метеосат" второго поколения и на спутниках фотосъемки "Метеосат" третьего поколения,
|
||
ОТМЕЧАЯ намерение Сторон Соглашения о Международной программе КОСПАС-САРСАТ
|
||
поддерживать ГССПС и то, что Подписавшиеся стороны желают придать в специальном
|
||
документе официальный статус своему долгосрочному сотрудничеству с целью продолжения
|
||
выполнения задачи по обеспечению функционирования ГССПС на четвертом спутнике
|
||
"Метеосат" второго поколения и спутниках фотосъемки "Метеосат" третьего поколения
|
||
ЕВМЕТСАТ,
|
||
СОГЛАСИЛИСЬ О СЛЕДУЮЩЕМ:
|
||
1.
|
||
ОПРЕДЕЛЕНИЯ
|
||
Для целей настоящей Договоренности:
|
||

|
||
"Соглашение" означает Соглашение о Международной программе КОСПАС-
|
||
САРСАТ, совершенное в Париже 1 июля 1988 г.
|
||
-
|
||
"Договоренность" означает настоящую Договоренность о сотрудничестве между
|
||
Сотрудничающими
|
||
организациями
|
||
Сторон
|
||
Соглашения
|
||
о
|
||
Международной
|
||
программе КОСПАС-САРСАТ и Европейской организацией по эксплуатации
|
||
метеорологических спутников (ЕВМЕТСАТ) в отношении вклада ЕВМЕТСАТ в
|
||
геостационарную спутниковую систему поиска и спасания Системы КОСПАС-
|
||
САРСАТ.
|
||

|
||
"Программа" означает осуществляемую Сторонами Соглашения и другими
|
||
государствами и организациями, которые официально уведомили о своем
|
||
присоединении к Соглашению о Международной программе КОСПАС-САРСАТ на
|
||
изложенных в нем условиях, деятельность по обеспечению, эксплуатации и
|
||
координации Системы КОСПАС-САРСАТ в соответствии с политикой, стандартами
|
||
и
|
||
процедурами,
|
||
описанными
|
||
в
|
||
документах
|
||
Системы
|
||
КОСПАС-САРСАТ,
|
||
одобренными Советом КОСПАС-САРСАТ.
|
||
-
|
||
"Сотрудничающие организации" означает организации, назначенные Сторонами
|
||
Соглашения в целях реализации Программы.
|
||
-
|
||
"Система КОСПАС-САРСАТ" означает спутниковую систему поиска и спасания,
|
||
включающую в себя:
|
||
а)
|
||
низкоорбитальные
|
||
спутники
|
||
космического
|
||
сегмента
|
||
низкоорбитальной
|
||
спутниковой системы поиска и спасания (НССПС), как определено в Статье 3
|
||
Соглашения,
|
||
b)
|
||
геостационарные спутники космического сегмента ГССПС, в соответствии с
|
||
решением Совета КОСПАС-САРСАТ, принятым согласно Статье 3.2
|
||
Соглашения,
|
||
c)
|
||
наземный сегмент, созданный Сторонами Соглашения или государствами,
|
||
обеспечивающими наземный сегмент на изложенных в Соглашении условиях,
|
||

включая станции приема и обработки информации, работающие со спутниками
|
||
низкоорбитальной и геостационарной спутниковых систем поиска и спасания, а
|
||
также координационные центры Системы КОСПАС-САРСАТ, и
|
||
d)
|
||
радиобуи, работающие на частоте 406 МГц, как это определено в Статье 3
|
||
Соглашения,
|
||
включая
|
||
радиобуи,
|
||
предоставляемые
|
||
государствами-
|
||
пользователями на изложенных в Соглашении условиях, или другими
|
||
государствами, самостоятельно использующими Систему КОСПАС-САРСАТ.
|
||

|
||
"ГССПС" означает ретрансляторы поиска и спасания 406 МГц в геостационарных
|
||
спутниковых системах, а также наземный сегмент для приема и обработки сигналов
|
||
радиобуев 406 МГц.
|
||
-
|
||
"Сетевая совместимость" означает, что ретрансляторы ГССПС ЕВМЕТСАТ
|
||
отвечают применимым эксплуатационным требованиям КОСПАС-САРСАТ и
|
||
позволяют наземному сегменту обрабатывать сигналы, ретранслированные от
|
||
радиобуев 406 МГц.
|
||
-
|
||
"Спутниковый сегмент "Метеосат" означает четвертый спутник "Метеосат" из
|
||
серии спутников второго поколения ЕВМЕТСАТ и спутники фотосъемки
|
||
"Метеосат" из серии спутников третьего поколения.
|
||
-
|
||
"Участники " означает государства и организации, которые официально уведомили
|
||
о своем присоединении к Программе на изложенных в Соглашении условиях.
|
||
2.
|
||
ЦЕЛИ И РАМКИ ДОГОВОРЕННОСТИ
|
||
2.1
|
||
Целью данной Договоренности является установление рамок сотрудничества между
|
||
Сотрудничающими организациями Сторон Соглашения и ЕВМЕТСАТ.
|
||
2.2
|
||
Рамками настоящей Договоренности является предоставление, запуск и эксплуатация
|
||
ретрансляторов 406 МГц ГССПС в космическом сегменте "Метеосат" и интеграция этого
|
||
потенциала ГССПС "Метеосат" в Систему КОСПАС-САРСАТ.
|
||
3.
|
||
ПРИНЦИПЫ СОТРУДНИЧЕСТВА
|
||
3.1
|
||
Данная Договоренность не является обязывающей в соответствии с международным
|
||
правом и не требует обмена ресурсами или технологиями между Подписавшимися
|
||
сторонами. Подписавшиеся стороны намерены осуществлять свою деятельность в
|
||
рамках
|
||
настоящей
|
||
Договоренности,
|
||
исходя
|
||
из
|
||
принципа
|
||
целесообразности.
|
||
Ретрансляторы ГССПС не являются приоритетом для разработки, эксплуатации и планов
|
||
развертывания космического и наземного сегментов "Метеосат".
|
||
3.2
|
||
Подписавшиеся стороны намерены координировать эксплуатацию ретрансляторов
|
||
ГССПС "Метеосат" в соответствии с принципами, изложенными в "Документе об
|
||
осуществлении контроля интерфейса для работы ЕВМЕТСАТ в ГССПС Системы
|
||
КОСПАС-САРСАТ" (ДКИ), принятым ЕВМЕТСАТ в сотрудничестве с КОСПАС-
|
||
САРСАТ.
|

4.
|
||
КООРДИНАЦИЯ ЧАСТОТ
|
||
4.1 Подписавшиеся стороны намерены сотрудничать по вопросам координации частот
|
||
радиолинии "борт-Земля" с целью предотвращения вредных помех Системе КОСПАС-
|
||
САРСАТ.
|
||
4.2
|
||
Ничто в настоящей Договоренности не заменяет, не изменяет или не ухудшает правила,
|
||
рекомендации и процедуры, принятые в Международном союзе электросвязи.
|
||
5.
|
||
РАСПРЕДЕЛЕНИЕ РОЛЕЙ И ФУНКЦИЙ
|
||
5.1 ЕВМЕТСАТ намерен обеспечивать, размещать и запускать как часть космического
|
||
сегмента "Метеосат" ретрансляторы ГССПС, которые передают радиосигналы от
|
||
радиобуев 406 МГц, отвечающих требованиям документа "Спецификация радиобуя 406
|
||
МГц КОСПАС-САРСАТ" (С/S T.001).
|
||
5.2
|
||
ЕВМЕТСАТ намерен эксплуатировать ретрансляторы ГССПС как составную часть всего
|
||
космического сегмента "Метеосат" в соответствии с ДКИ.
|
||
5.3
|
||
Сотрудничающие
|
||
организации
|
||
намерены
|
||
осуществлять
|
||
прием
|
||
в
|
||
эксплуатацию
|
||
ретрансляторов ГССПС "Метеосат" после их вывода на орбиту посредством назначения
|
||
Сотрудничающей организации по выполнению данного задания в сотрудничестве с
|
||
ЕВМЕТСАТ и в соответствии с положениями ДКИ.
|
||
5.4
|
||
Сотрудничающие организации намерены предоставлять и эксплуатировать напрямую
|
||
или через других Участников Программы наземный сегмент ГССПС и они отдают свое
|
||
предпочтение использованию широкого луча радиолинии "борт-Земля" в диапазоне
|
||
частот 1544 - 1545 МГц.
|
||
5.5. Подписавшиеся стороны назначают Руководителя программы ЕВМЕТСАТ и Начальника
|
||
Секретариата КОСПАС-САРСАТ в качестве официальных точек контакта по вопросам,
|
||
касающимся данной Договоренности. Подписавшиеся стороны назначат также свои
|
||
рабочие точки контакта в ДКИ.
|
||
6.
|
||
КООРДИНАЦИЯ ДЕЙСТВИЙ
|
||
Подписавшиеся стороны намерены координировать свою деятельность по реализации
|
||
настоящей Договоренности в рамках Программы, которая включает участие ЕВМЕТСАТ
|
||
в работе следующих заседаний по мере необходимости:
|
||
а)
|
||
открытые заседания сессий Совета КОСПАС-САРСАТ, рассматривающие вопросы
|
||
управления и планирования;
|
||
b)
|
||
заседания
|
||
Объединенного
|
||
комитета
|
||
КОСПАС-САРСАТ,
|
||
рассматривающие
|
||
техническую и эксплуатационную деятельность, включая разработку или изменение
|
||
спецификаций и документов, касающихся развития космического и наземного
|
||
сегментов ГССПС, а также демонстрации и оценки ГССПС;
|
||
с)
|
||
целевые группы КОСПАС-САРСАТ, создаваемые для рассмотрения специальных
|
||
технических и эксплуатационных вопросов, представляющих общий интерес; и
|
||

d)
|
||
экспертные рабочие группы КОСПАС-САРСАТ, созываемые Советом КОСПАС-
|
||
САРСАТ в надлежащих случаях для рассмотрения вопросов, представляющих
|
||
особый интерес для Подписавшихся сторон.

||
7.
|
||
ФИНАНСОВЫЕ ВОПРОСЫ
|
||
Подписавшиеся стороны не намерены обмениваться фондами. Деятельность каждой
|
||
Подписавшейся стороны по настоящей Договоренности осуществляется при условии
|
||
наличия у нее соответствующих фондов.
|
||
8.
|
||
РАЗЛИЧИЯ В ИНТЕРПРЕТАЦИИ И ПРИМЕНЕНИИ
|
||
Подписавшиеся стороны намерены решать любые различия в интерпретации или
|
||
выполнении данной Договоренности посредством консультаций и переговоров.
|
||
9.
|
||
ДАТА ВСТУПЛЕНИЯ В ДЕЙСТВИЕ, ПРОДОЛЖИТЕЛЬНОСТЬ И ПОПРАВКИ
|
||
9.1
|
||
Данная Договоренность вступает в действие после последней подписи Подписавшихся
|
||
сторон и остается в действии в течение срока эксплуатации космического сегмента
|
||
"Метеосат".
|
||
9.2
|
||
Подписавшиеся
|
||
стороны
|
||
могут
|
||
дополнять
|
||
или
|
||
вносить
|
||
поправки
|
||
в
|
||
данную
|
||
Договоренность по взаимному письменному согласию.
|
||
Совершено в шести (6) экземплярах на английском, французском и русском языках, причем
|
||
все тексты имеют одинаковое содержание.
