CONCERNING THE ASSOCIATION OF THE REPUBLIC OF INDIA
|
||
WITH THE COSPAS-SARSAT PROGRAMME AS A PROVIDER OF
|
||
GEOSTATIONARY SATELLITE SERVICES FOR SEARCH AND RESCUE
|
||
(GEOSAR)
|
||
The States Parties to the International COSPAS-SARSAT Programme Agreement and the
|
||
Republic of India:
|
||
NOTING the successful implementation of the COSPAS-SARSAT Search and Rescue
|
||
Satellite System established and operated under the terms of the International
|
||
COSPAS-SARSAT Programme Agreement between Canada, the Republic of France, the
|
||
Union of Soviet Socialist Republics and the United States of America, which was signed on
|
||
1 July 1988 and entered into force on 30 August 1988;
|
||
NOTING that the Russian Federation formally notified one of the Depositaries of the
|
||
International COSPAS-SARSAT Programme Agreement on 6 January 1992 that it was
|
||
maintaining all rights and obligations of the former Union of Soviet Socialist Republics in the
|
||
International COSPAS-SARSAT Programme;
|
||
NOTING the commitment of the Parties to the International COSPAS-SARSAT Programme
|
||
Agreement to assure the long-term operation of the COSPAS-SARSAT System and access to
|
||
this System to all States on a non-discriminatory basis, and free of charge to the end-user in
|
||
distress;
|
||
NOTING the Letter of Notification of Association with the International COSPAS-SARSAT
|
||
Programme deposited by the Government of the Republic of India with the Secretary General
|
||
of the International Civil Aviation Organization on 23 April 1991, and that the association of
|
||
the Republic of India with the COSPAS-SARSAT Programme as a Ground Segment Provider
|
||
took effect on 23 May 1991;
|
||
NOTING the successful Demonstration and Evaluation (D&E) phase of the 406 MHz
|
||
geostationary satellite system for search and rescue (GEOSAR), the contribution of the
|
||
INSAT-2 GEOSAR system to the D&E, and the decision of the COSPAS-SARSAT Council
|
||
at its CSC-21 Session to "adopt the D&E conclusion that the enhancement of the COSPAS-
|
||
SARSAT System through the integration of 406 MHz GEOSAR components was desirable
|
||
and should be implemented as soon as possible";
|
||
NOTING that other GEOSAR systems had already been integrated into the COSPAS-
|
||
SARSAT System;
|
||
CONSIDERING Article 3.2 of the International COSPAS-SARSAT Programme Agreement,
|
||
which provides for the enhancement of the COSPAS-SARSAT Space Segment in accordance
|
||
with decisions of the COSPAS-SARSAT Council;
|
||
|
||

CONSIDERING in addition Article 9 of the International COSPAS-SARSAT Programme
|
||
Agreement, which states that the functions of the COSPAS-SARSAT Council include, inter
|
||
alia:
|
||
9(g) the assessment of the need for technical and operational enhancements of the
|
||
System, including those relating to contributions of the Parties and those which
|
||
would entail contributions by States non-Parties to the Agreement; and
|
||
9(i) taking decisions upon matters of joint relations with States non-Parties to the
|
||
Agreement;
|
||
RECOGNISING the decision made by the Republic of India to include a 406 MHz search
|
||
and rescue mission on operational geostationary satellites and the enhancement to the
|
||
COSPAS-SARSAT GEOSAR coverage that will result from the integration of the Republic
|
||
of India's GEOSAR system into the COSPAS-SARSAT System; and
|
||
NOTING the COSPAS-SARSAT Council decision made at its CSC-29 Session that it is,
|
||
therefore, desirable to enhance the COSPAS-SARSAT satellite system with the formal
|
||
integration into that system of the 406 MHz GEOSAR capability provided by the Republic of
|
||
India;
|
||
State their understanding as follows:
|
||
1.
|
||
DEFINITIONS
|
||
- "Agreement" means the International COSPAS-SARSAT Programme Agreement;
|
||
- "Understanding" means the present Understanding between the States Parties to the
|
||
Agreement and the Republic of India concerning the association of the Republic of
|
||
India with the COSPAS-SARSAT Programme as a provider of geostationary
|
||
satellite services for search and rescue (GEOSAR);
|
||
- "COSPAS-SARSAT Parties" means the Parties to the Agreement;
|
||
- "Programme" means those activities carried out by the COSPAS-SARSAT Parties
|
||
under the terms of the Agreement, to provide, operate and co-ordinate the
|
||
COSPAS-SARSAT System in accordance with the Agreement;
|
||
- "System" means the COSPAS-SARSAT System comprising:
|
||
a) the low-altitude Earth-orbiting satellites of the LEOSAR (low-altitude Earth
|
||
orbit satellite system for SAR) Space Segment described in Article 3 of the
|
||
Agreement,
|
||
b) the geostationary Earth-orbiting satellites of the GEOSAR Space Segment as
|
||
decided by the Council pursuant to Article 3.2 of the Agreement,
|
||
c) the Ground Segment established by the Parties or by Ground Segment Providers
|
||
under the terms of the Agreement, including Local User Terminals operating
|
||
with the LEOSAR and GEOSAR satellites of the Space Segment and Mission
|
||
Control Centres, and
|
||
|

d) radiobeacons operating at 406 MHz and 121.5 MHz frequencies as described at
|
||
Article 3 of the Agreement, including the radiobeacons provided by User States
|
||
under the terms of the Agreement, or by other States that avail themselves of the
|
||
System;
|
||
- "Council" means the Council established pursuant to the Agreement;
|
||
- "Secretariat" means the Secretariat established pursuant to the Agreement;
|
||
- "Space Segment Provider" means a State that provides and operates Space Segment
|
||
equipment as described in Article 3 of the Agreement, and/or enhancements to the
|
||
Space Segment as decided by the Council pursuant to Article 3.2 of the
|
||
Agreement;
|
||
- "GEOSAR Provider" means a State that establishes and operates geostationary
|
||
Space Segment and Ground Segment equipment as agreed with the Council
|
||
pursuant to Article 3.2 of the Agreement;
|
||
- "Ground Segment Provider" means any State which establishes and operates
|
||
Ground Segment equipment, and avails itself of the System, under Article 11 of the
|
||
Agreement;
|
||
- "User State" means any State that avails itself of the System under Article 12 of the
|
||
Agreement.
|
||
2.
|
||
SCOPE AND OBJECTIVES OF THE ASSOCIATION OF THE REPUBLIC OF
|
||
INDIA WITH THE PROGRAMME AS A GEOSAR PROVIDER
|
||
2.1
|
||
The objectives of the association of the Republic of India with the Programme, as stated
|
||
in the Letter of Notification of Association with the International COSPAS-SARSAT
|
||
Programme as a Ground Segment Provider deposited by the Government of the
|
||
Republic of India with the Secretary General of the International Civil Aviation
|
||
Organization on 23 April 1991, which took effect on 23 May 1991, are to:
|
||
a) contribute to the long-term operation of the System;
|
||
b) provide distress alert and location data from the System to the international
|
||
community in support of search and rescue (SAR) operations on a non-discriminatory
|
||
basis;
|
||
c) support, by providing these distress alert and location data, the objectives of the
|
||
International Maritime Organization and the International Civil Aviation Organization
|
||
concerning search and rescue; and
|
||
d) cooperate with other national authorities and relevant international organizations in the
|
||
operation and co-ordination of the System.
|
||
2.2
|
||
In order to implement these objectives, the Republic of India has installed and operates
|
||
Ground Segment equipment for the LEOSAR system, in accordance with the
|
||
requirements of the LEOSAR ground segment specifications and commissioning
|
||
standards approved by the COSPAS-SARSAT Council.

||

2.3
|
||
In addition to the above contributions, the Republic of India has agreed to associate itself
|
||
with the Programme as a GEOSAR Provider and to:
|
||
a) contribute and operate on a long-term basis 406 MHz GEOSAR Space Segment
|
||
equipment consisting of payloads carried on board geostationary satellites in the
|
||
INSAT series, or other future geostationary satellites, for the purpose of ensuring,
|
||
under normal operating conditions, the operational availability of the 406 MHz
|
||
INSAT GEOSAR coverage, as agreed with the COSPAS-SARSAT Council and
|
||
described in the appropriate COSPAS-SARSAT System documents;
|
||
b) establish and operate Ground Segment equipment consisting of at least one Local User
|
||
Terminal for reliably receiving and processing the signals of COSPAS-SARSAT
|
||
406 MHz radiobeacons relayed by the INSAT GEOSAR Space Segment, with a view
|
||
to distributing internationally the received GEOSAR alerts, in accordance with the
|
||
agreed COSPAS-SARSAT data distribution procedures; and
|
||
c) consider possible future enhancements to their GEOSAR Space Segment, with a view
|
||
to enabling direct access to the GEOSAR alert data by other Ground Segment
|
||
operators in the INSAT GEOSAR coverage area provided by their GEOSAR Space
|
||
Segment contribution.
|
||
3.
|
||
STATEMENT OF THE REPUBLIC OF INDIA'S CONTRIBUTION AS A
|
||
GEOSAR PROVIDER
|
||
3.1
|
||
Recognising the narrow beam configuration of the INSAT geostationary satellite
|
||
downlink and the concern that this configuration does not provide an opportunity for
|
||
other Ground Segment Providers to directly receive and process the signals of 406 MHz
|
||
radiobeacons relayed via the INSAT GEOSAR satellites, the Republic of India as a
|
||
GEOSAR Provider in the COSPAS-SARSAT System, intends:
|
||
a) to commission and operate its Space Segment contribution to the COSPAS-SARSAT
|
||
GEOSAR system in accordance with the procedures agreed with the COSPAS-
|
||
SARSAT Council;
|
||
b) to ensure, under normal operating conditions, the continuity of the INSAT GEOSAR
|
||
coverage of the 406 MHz frequency band;
|
||
c) to commission and operate its GEOSAR Ground Segment equipment in accordance
|
||
with procedures and guidelines agreed with the COSPAS-SARSAT Council for the
|
||
purpose of ensuring adequate System performance and the required availability of
|
||
GEOSAR alert data; and
|
||
d) to ensure the timely and reliable distribution of GEOSAR alert data by the Indian
|
||
Mission Control Centre to SAR authorities and/or other COSPAS-SARSAT Mission
|
||
Control Centres, in accordance with the approved COSPAS-SARSAT Data
|
||
Distribution Plan.
|
||
3.2
|
||
The contribution defined above do not modify the duties of the Republic of India as a
|
||
Ground Segment Provider, which result from the Republic of India's notification of
|
||
|

association with the Programme referred to in the preamble and section 2.2 of this
|
||
Understanding.
|
||
3.3
|
||
The present Understanding is not to be interpreted as involving the Republic of India in
|
||
any duties beyond the terms of this Understanding, and the Republic of India is not
|
||
expected to carry out any new responsibility, before a period of time agreed with the
|
||
Council or accept without prior consent modifications to any existing obligation under its
|
||
association with the Programme as a Ground Segment Provider.
|
||
4.
|
||
AGENCY
|
||
AND
|
||
REPRESENTATION
|
||
IN
|
||
THE
|
||
MEETINGS
|
||
OF
|
||
THE
|
||
PROGRAMME
|
||
4.1
|
||
The signatories to this Understanding note that, to efficiently discharge its duties as a
|
||
GEOSAR Provider, the Republic of India should endeavour to participate as necessary in
|
||
appropriate meetings of the Programme convened by the Council, including the open
|
||
meetings of the Council and its subsidiary organs, with a view to resolving relevant
|
||
administrative, operational and technical issues.
|
||
4.2
|
||
The Indian Space Research Organisation (ISRO) is the Agency designated by the
|
||
Republic of India to fulfil the Republic of India's duties pursuant to its association with
|
||
the Programme as a Ground Segment Provider. ISRO is also responsible for the
|
||
implementation of the Republic of India's contribution to the COSPAS-SARSAT
|
||
System as a GEOSAR Provider in accordance with paragraphs 2 and 3 of this
|
||
Understanding.
|
||
4.3
|
||
The Republic of India accepts that the participation of its representatives in the meetings
|
||
of the Programme is to be in accordance with the applicable provisions of the Agreement
|
||
and the applicable rules of procedure adopted by the Council.
|
||
5.
|
||
LIABILITY
|
||
5.1
|
||
The signatories to this Understanding accept that the COSPAS-SARSAT Parties, the
|
||
Republic of India and other States associated with the Programme are not to make any
|
||
claim or bring actions against each other for injury, damage or financial losses arising out
|
||
of activities, or lack thereof, pursuant to its association with the Programme or its use of
|
||
the System.
|
||
5.2
|
||
The Republic of India accepts no liability towards users of the System, including
|
||
COSPAS-SARSAT Parties, Space Segment Providers, Ground Segment Providers and
|
||
User States, or any third party, particularly as regards any claims for injury, damages or
|
||
financial losses that may arise from their use of the System.
|
||
6.
|
||
FINANCIAL MATTERS
|
||
6.1
|
||
The Republic of India, in conformity with its domestic funding procedures and subject to
|
||
the availability of appropriated funds, is fully responsible for financing all costs
|
||
associated with its contribution to the System as defined in paragraphs 2 and 3 of this
|
||
Understanding.
|
||

6.2
|
||
In accordance with Article 6 of the Agreement, the Republic of India is prepared to
|
||
contribute the standard annual amount, determined from time to time by the Council in
|
||
agreement with non-Party States associated with the Programme, towards the common
|
||
costs associated with the organization, administration and co-ordination of the
|
||
Programme.
|
||
6.3
|
||
In accordance with Article 6 of the Agreement, common costs referred to in
|
||
paragraph 6.2 of this Understanding do not include any costs associated with the
|
||
reception and transmission of distress alert data through the COSPAS-SARSAT Space
|
||
Segment, including the Republic of India's GEOSAR space segment equipment, which
|
||
are provided by the COSPAS-SARSAT Parties and by other GEOSAR Providers free of
|
||
charge to all States.
|
||
7.
|
||
ENTRY INTO FORCE AND TERMINATION
|
||
7.1
|
||
This Understanding will become effective 30 days after the date of the last signature.
|
||
7.2
|
||
The Republic of India may terminate unilaterally its contribution to the Programme as a
|
||
GEOSAR Provider by notifying the Chairman of the Council, through the Secretariat, of
|
||
its intent to do so. Such termination is to take effect 180 days after the date of receipt of
|
||
the notification by the Secretariat. The Secretariat is to inform the COSPAS-SARSAT
|
||
Parties of the Republic of India's intent to terminate unilaterally its contribution as a
|
||
GEOSAR Provider.
|
||
7.3
|
||
The Republic of India accepts that, unless terminated in accordance with paragraphs 7.2
|
||
of this Understanding, its contribution to the COSPAS-SARSAT Space Segment is to
|
||
remain effective until the Agreement ceases to be in force, in which case the Republic of
|
||
India's association with the Programme and its contribution as a GEOSAR Provider will
|
||
be automatically terminated.
|
||
7.4
|
||
The Secretariat will provide each of the Depositaries of the Agreement with one original
|
||
copy of this Understanding.
|
||
Done in eight copies in the English, French and Russian languages, each version being equally
|
||
valid.

||
Les États Parties à l'Accord relatif au programme international COSPAS-SARSAT et la
|
||
République de l'Inde:
|
||
CONSTATANT le succès de la mise en oeuvre du système COSPAS-SARSAT d'aide aux
|
||
recherches et au sauvetage par satellites établi et exploité en vertu de l'Accord relatif au
|
||
Programme international COSPAS-SARSAT conclu entre le Canada, la République Française,
|
||
l'Union des Républiques Socialistes Soviétiques et les États-Unis d'Amérique, signé le 1er juillet
|
||
1988 et entré en vigueur le 30 août 1988 ;
|
||
CONSTATANT que la Fédération de Russie a formellement notifié le 6 janvier 1992 à l'un des

CONSTATANT l'engagement des Parties à l'Accord relatif au programme international

COSPAS-SARSAT d'assurer l'exploitation à long terme du système COSPAS-SARSAT et de le

rendre accessible à tous les États sur une base non discriminatoire et gratuite pour l'utilisateur en
|
||
détresse ;
|
||
CONSTATANT la lettre de Notification d'Association au programme international COSPAS-
|

SARSAT déposée par le gouvernement de la République de l'Inde auprès du Secrétaire Général

9(i) la prise de décisions sur les questions touchant aux relations avec les États
|
||
non-Parties à l'Accord ;
|
||
RECONNAISSANT la décision de la République de l'Inde d'inclure une mission de recherches
|
||
et sauvetage à 406 MHz à bord de satellites géostationnaires opérationnels et l'amélioration de la
|
||
couverture GEOSAR COSPAS-SARSAT qu'apportera l'intégration du système GEOSAR de la
|
||
République de l'Inde au système COSPAS-SARSAT ; et
|
||
CONSTATANT la décision du Conseil COSPAS-SARSAT lors de sa 29ème Session qu'il est, par
|
||
conséquent, souhaitable d'améliorer le système COSPAS-SARSAT par satellites par l'intégration
|
||
formelle de la capacité GEOSAR à 406 MHz fournie par la République de l'Inde ;
|
||
Sont convenus de ce qui suit:
|
||
1.
|
||
DÉFINITIONS
|
||
- Le terme « Accord » désigne l'Accord relatif au programme international COSPAS-
|
||
SARSAT ;
|
||
- le terme « Arrangement » désigne le présent Arrangement entre les États Parties à
|
||
l'Accord COSPAS-SARSAT et la République de l'Inde concernant l'association de la
|
||
République de l'Inde au Programme COSPAS-SARSAT en qualité de fournisseur de
|
||
services par satellites géostationnaires pour les recherches et le sauvetage (GEOSAR) ;
|
||
- le terme « Parties COSPAS-SARSAT » désigne les Parties à l'Accord ;
|
||
- le terme « Programme » désigne les activités entreprises par les Parties COSPAS-
|
||
SARSAT dans le cadre de l'Accord, pour fournir, exploiter et coordonner le système
|
||
COSPAS-SARSAT conformément à l'Accord ;
|
||
- le terme « Système » désigne le système COSPAS-SARSAT comprenant :
|
||
a) les satellites en orbite polaire basse altitude du segment spatial LEOSAR (système
|
||
de satellites en orbite polaire basse altitude pour les recherches et le sauvetage)
|
||
décrit à l'article 3 de l'Accord,
|
||
b) les satellites en orbite géostationnaire du segment spatial GEOSAR, tel que décidé
|
||
par le Conseil conformément à l'article 3.2 de l'Accord,
|
||
c) le segment sol mis en place par les Parties ou par les Fournisseurs du segment sol
|
||
aux termes de l'Accord, y compris les stations terriennes à utilisation locale
|
||
fonctionnant avec les satellites LEOSAR et GEOSAR du segment spatial et des
|
||
centres de contrôle de mission, et
|
||
d) les radiobalises fonctionnant sur les fréquences 406 MHz et 121,5 MHz telles que
|
||
décrites à l'article 3 de l'Accord, y compris les radiobalises fournies par les États
|
||

- l'expression « Fournisseur du segment spatial » désigne un État qui met en place et
|
||
exploite des équipements du segment spatial tel que décrit à l'article 3 de l'Accord, et/ou
|
||
apporte des améliorations au segment spatial tel que décidé par le Conseil aux termes de
|
||
l'article 3.2 de l'Accord ;
|
||
- l'expression « Fournisseur GEOSAR » désigne un État qui met en place et exploite un
|
||
segment spatial géostationnaire et des équipements du segment sol tel que convenu avec
|
||
le Conseil aux termes de l'article 3.2 de l'Accord ;
|
||
- l'expression « Fournisseur du segment sol » désigne tout État qui met en place et
|
||
exploite des équipements du segment sol et se sert du Système aux termes de l'article 11
|
||
de l'Accord ;
|
||
- l'expression « État Utilisateur » désigne tout État qui se sert du Système aux termes de
|
||
l'article 12 de l'Accord.
|
||
2.
|
||
PORTÉE ET OBJECTIFS DE L'ASSOCIATION DE LA RÉPUBLIQUE DE
|
||
L'INDE AU PROGRAMME EN QUALITÉ DE FOURNISSEUR GEOSAR
|
||
2.1
|
||
Les objectifs de l'association de la République de l'Inde au Programme, tels que stipulés
|
||
dans la Lettre de notification d'association au programme international COSPAS-SARSAT
|
||
en qualité de Fournisseur du segment sol déposée par le gouvernement de la République de
|
||
l'Inde auprès du Secrétaire Général de l'Organisation de l'Aviation Civile Internationale le
|
||
23 avril 1991, et ayant pris effet le 23 mai 1991, sont :
|
||
a) de contribuer à l'exploitation à long terme du Système ;
|
||
b) de fournir à la communauté internationale sur une base non-discriminatoire, les
|
||
données d'alerte et de localisation de détresse provenant du Système, pour aider les
|
||
opérations de recherche et de sauvetage (SAR) ;
|
||
c) de concourir, en fournissant les données d'alerte et de localisation, aux objectifs de
|
||
l'Organisation Maritime Internationale et de l'Organisation de l'Aviation Civile
|
||
Internationale, dans le domaine des recherches et du sauvetage ; et
|
||
d) de coopérer avec d'autres autorités nationales et les organisations internationales
|
||
concernées pour assurer l'exploitation et la coordination du Système.

||
2.2
|
||
Dans le but de réaliser ces objectifs, la République de l'Inde a mis en place et exploite des
|
||
équipements du segment sol pour le système LEOSAR, conformément aux spécifications
|
||
du segment sol LEOSAR et aux normes de mise en service approuvées par le Conseil
|
||
COSPAS-SARSAT.

2.3
|
||
En plus des contributions ci-dessus, la République de l'Inde a convenu de s'associer au
|
||
Programme en qualité de Fournisseur GEOSAR et :
|
||
a) de contribuer et d'exploiter à long terme les équipements du segment spatial GEOSAR
|
||
à 406 MHz comprenant des charges utiles installées à bord des satellites
|
||
géostationnaires de la série INSAT, ou d'autres satellites géostationnaires futurs, dans
|
||
le but d'assurer, dans des conditions normales d'exploitation, la disponibilité
|
||
opérationnelle de la couverture GEOSAR à 406 MHz des satellites INSAT, tel que
|
||
convenu avec le Conseil COSPAS-SARSAT et décrit dans les documents appropriés
|
||
du système COSPAS-SARSAT ;
|
||
b) de mettre en place et d'exploiter des équipements du segment sol comprenant au moins
|
||
une station terrienne à utilisation locale pour recevoir et traiter de façon fiable les
|
||
signaux des radiobalises COSPAS-SARSAT à 406 MHz relayés par le segment spatial
|
||
GEOSAR INSAT, en vue de distribuer à l'échelle internationale les alertes GEOSAR
|
||
reçues, conformément aux procédures COSPAS-SARSAT agréées pour la distribution
|
||
des données d'alerte ; et
|
||
c) d'envisager de futures améliorations possibles de son segment spatial GEOSAR, en
|
||
vue de permettre un accès direct aux données d'alerte GEOSAR par d'autres
|
||
opérateurs du segment sol situés dans la zone de couverture GEOSAR d'INSAT
|
||
résultant de la contribution de la République de l'Inde au segment spatial GEOSAR.
|
||
3.
|
||
CONTRIBUTION DE LA RÉPUBLIQUE DE L'INDE EN QUALITÉ DE
|
||
FOURNISSEUR GEOSAR
|
||
3.1
|
||
Reconnaissant que la liaison descendante du satellite géostationnaire INSAT est fournie par
|
||
un faisceau étroit, et que cette configuration ne permet pas aux autres fournisseurs du
|
||
segment sol de recevoir et de traiter directement les signaux des radiobalises à 406 MHz
|
||
relayés par les satellites GEOSAR INSAT, la République de l'Inde, en sa qualité de
|
||
Fournisseur GEOSAR au sein du système COSPAS-SARSAT, entend :
|
||
a) mettre en service et exploiter sa contribution au segment spatial du système GEOSAR
|
||
COSPAS-SARSAT conformément aux procédures convenues avec le Conseil
|
||
COSPAS-SARSAT ;
|
||
b) assurer, dans des conditions normales d'exploitation, la continuité de la couverture
|
||
GEOSAR d'INSAT pour la bande de fréquence à 406 MHz ;
|
||
c) mettre en service et exploiter ses équipements du segment sol GEOSAR conformément
|
||
aux procédures et aux pratiques convenues avec le Conseil COSPAS-SARSAT dans le
|
||
but d'assurer une performance adéquate du Système et la disponibilité requise des
|
||
données d'alerte GEOSAR ; et
|
||
d) assurer la distribution fiable et ponctuelle des données d'alerte GEOSAR par le centre
|
||
de contrôle de mission indien aux autorités SAR et/ou aux autres centres de contrôle de
|
||
mission COSPAS-SARSAT, conformément au plan de distribution des données
|
||
COSPAS-SARSAT.
|
||
3.2
|
||
La contribution qui précède est sans préjudice des engagements qui incombent à la
|
||
République de l'Inde en vertu de la notification d'association au Programme en qualité de
|
||

Fournisseur du segment sol dont il est fait mention dans le préambule et la section 2.2 du
|
||
présent Arrangement.

||
3.3
|
||
Aux termes du présent Arrangement, la République de l'Inde ne s'engage pas au-delà de la
|
||
contribution convenue dans le présent Arrangement, de même qu'il ne peut lui être
|
||
demandé d'assumer de nouvelles responsabilités avant l'échéance d'un terme à convenir
|
||
avec le Conseil, ni d'accepter des modifications aux obligations existantes dans le cadre de
|
||
son association au Programme en qualité de Fournisseur du segment sol, à moins qu'elle
|
||
n'y consente.
|
||
4.
|
||
AGENCE ET REPRÉSENTATION AUX RÉUNIONS DU PROGRAMME
|
||
4.1
|
||
Les signataires du présent Arrangement notent que pour s'acquitter efficacement de ses
|
||
engagements en qualité de Fournisseur GEOSAR, la République de l'Inde s'efforcera de
|
||
participer, autant que nécessaire, aux réunions appropriées du Programme convoquées par
|
||
le Conseil, y compris les réunions ouvertes du Conseil et de ses organes subsidiaires, afin
|
||
de résoudre les questions administratives, opérationnelles et techniques pertinentes.
|
||
4.2
|
||
L'Agence indienne pour la recherche spatiale (ISRO) est l'agence désignée par la
|
||
République de l'Inde pour assumer les responsabilités de la République de l'Inde dans le
|
||
cadre de son association au Programme en qualité de Fournisseur du segment sol. L' ISRO
|
||
est également responsable de la mise en oeuvre de la contribution de la République de
|
||
l'Inde au Système COSPAS-SARSAT en tant que Fournisseur GEOSAR conformément
|
||
aux paragraphes 2 et 3 du présent Arrangement.
|
||
4.3
|
||
La République de L'Inde convient de ce que la participation de ses représentants aux
|
||
réunions du Programme s'effectue conformément aux dispositions pertinentes de l'Accord
|
||
relatif au programme international COSPAS-SARSAT, ainsi qu'au règlement intérieur
|
||
pertinent, tel qu'adopté par le Conseil.
|
||
5.
|
||
RESPONSABILITÉS
|
||
5.1
|
||
Les signataires du présent Arrangement ne présenteront aucune demande de réparation et
|
||
n'intenteront aucune action envers les Parties COSPAS-SARSAT, la République de l'Inde
|
||
et les autres États associés au Programme, en cas de préjudices corporels, dommages ou
|
||
pertes financières survenant à l'occasion de l'exécution ou de la non-exécution des activités
|
||
résultant de leur participation au Programme ou de leur utilisation du Système.
|
||
5.2
|
||
La République de L'Inde n'accepte aucune responsabilité vis-à-vis des utilisateurs du
|
||
Système, y compris les Parties COSPAS-SARSAT, les Fournisseurs du segment spatial, les
|
||
Fournisseurs du segment sol et les États Utilisateurs, ou vis-à-vis de tout tiers, en particulier
|
||
en ce qui concerne toute demande de réparation pour préjudices corporels, dommages ou
|
||
pertes financières qui peuvent survenir par suite de leur utilisation du Système.
|
||
6.
|
||
ASPECTS FINANCIERS
|
||
6.1
|
||
La République de l'Inde assume, conformément à ses règles budgétaires nationales et sous
|
||
réserve de l'affectation des crédits alloués, l'ensemble des coûts relatifs à sa contribution au
|
||
Système, telle que définie aux paragraphes 2 et 3 du présent Arrangement.

6.2
|
||
Conformément à l'article 6 de l'Accord, la République de l'Inde est disposée à verser une
|
||
cotisation annuelle forfaitaire, fixée périodiquement par le Conseil en accord avec les États
|
||
non-Partie associés au Programme, pour contribuer aux charges communes afférentes à
|
||
l'organisation, l'administration et la coordination du Programme.
|
||
6.3
|
||
Conformément à l'article 6 de l'Accord, les charges communes mentionnées au
|
||
paragraphe 6.2 du présent Arrangement n'incluent aucun des coûts afférents à la réception
|
||
et la transmission des données d'alerte via le segment spatial COSPAS-SARSAT, y
|
||
compris les équipements du segment spatial GEOSAR de la République de l'Inde, qui sont
|
||
fournies gratuitement à tous les États par les Parties COSPAS-SARSAT et par tous les
|
||
autres Fournisseurs GEOSAR.
|
||
7.
|
||
DATE DE PRISE D'EFFET ET TERMINAISON
|
||
7.1
|
||
Le présent Arrangement prend effet 30 jours après la date de la dernière signature.
|
||
7.2
|
||
La République de l'Inde peut terminer unilatéralement son association au Programme en sa
|
||
qualité de Fournisseur GEOSAR en notifiant son intention au président du Conseil, via le
|
||
Secrétariat. Une telle terminaison prend effet 180 jours après la date de réception de la
|
||
notification par le Secrétariat. Le Secrétariat informe les Parties COSPAS-SARSAT de
|
||
l'intention de la République de l'Inde de terminer unilatéralement son association en
|
||
qualité de Fournisseur GEOSAR.
|
||
7.3
|
||
La République de l'Inde convient de ce que, sauf en cas de terminaison conformément au
|
||
paragraphe 7.2 du présent Arrangement, sa contribution au segment spatial COSPAS-
|
||
SARSAT reste effective jusqu'à ce que l'Accord cesse d'être en vigueur, auquel cas
|
||
l'association de la République de l'Inde au Programme et sa contribution en qualité de
|
||
fournisseur GEOSAR sont automatiquement terminées.
|
||
7.4
|
||
Le Secrétariat fournira à chacun des dépositaires de l'Accord une copie originale du présent
|
||
Arrangement.
|
||
Fait en huit exemplaires en langue anglaise, française et russe, chaque version étant également
|
||
valide.

между

Союзом

Социалистических Республик, Канадой, Французской Республикой и Соединенными Штатами

Америки, которое было подписано 1 июля 1988 г. и вступило в силу 30 августа 1988 г.,
|
||
ОТМЕЧАЯ, что 6 января 1992 г. Российская Федерация официально уведомила одного из
|
||
депозитариев Соглашения о Международной программе "КОСПАС-САРСАТ", что она берет
|
||
на себя все права и обязательства бывшего Союза Советских Социалистических Республик в
|
||
Международной программе "КОСПАС-САРСАТ",
|
||
ОТМЕЧАЯ обязательства Сторон Соглашения о Международной программе "КОСПАС-
|
||
САРСАТ" обеспечивать долговременную эксплуатацию спутниковой cистемы поиска и
|
||
спасания "КОСПАС-САРСАТ", а также предоставлять к ней доступ всем государствам на
|
||
недискриминационной основе и бесплатно - для пользователей этой Системы, находящихся в
|
||
аварийной ситуации,
|
||
ОТМЕЧАЯ письмо-уведомление о присоединении к Международной программе "КОСПАС-
|
||
САРСАТ", сданное на хранение Правительством Республики Индии генеральному секретарю
|
||
Международной организации гражданской авиации 23 апреля 1991 г., и вступление в силу
|
||
присоединения Республики Индии к Международной программе "КОСПАС-САРСАТ" 23 мая

1991 г.,
|
||
ОТМЕЧАЯ успешную фазу демонстрации и оценки геостационарной спутниковой системы
|
||
для обеспечения поиска и спасания (ГССПС), работающей на частоте 406 МГц, вклад в
|
||
демонстрацию и оценку системы ГССПС ИНСАТ-2, а также принятое на 21-й сессии Совета
|
||
"КОСПАС-САРСАТ" решение одобрить заключение на результаты демонстрации и оценки
|
||
относительно того, что дополнение спутниковой системы поиска и спасания "КОСПАС-
|
||
САРСАТ" путем интеграции элементов системы ГССПС, работающей на частоте 406 МГц,
|
||
желательно и должно быть выполнено как можно скорее,
|
||
ОТМЕЧАЯ, что другие системы ГССПС уже интегрированы в спутниковую cистему поиска и
|
||
спасания "КОСПАС-САРСАТ",
|
||
ПРИНИМАЯ ВО ВНИМАНИЕ cтатью 3.2 Соглашения о Международной программе
|
||
"КОСПАС-САРСАТ", которая оговаривает возможность дополнения космического сегмента
|
||
"КОСПАС-САРСАТ" по решению Совета "КОСПАС-САРСАТ",
|
||
ПРИНИМАЯ ВО ВНИМАНИЕ дополнительно cтатью 9 Соглашения о Международной
|
||
программе "КОСПАС-САРСАТ", в соответствии с которой в функции Совета "КОСПАС-
|
||
САРСАТ" входят в том числе:
|
||

"9(g) оценка потребности в технических и эксплуатационных дополнениях, в том числе

принятие решений по вопросам взаимоотношений с государствами, не
|
||
являющимися Сторонами настоящего Соглашения;",
|
||
ПРИЗНАВАЯ решение Республики Индии об установке поисково-спасательных средств,
|
||
работающих на частоте 406 МГц, на эксплуатируемых геостационарных спутниках и
|
||
дополнение зоны видимости ГССПС "КОСПАС-САРСАТ" за счет интеграции системы
|
||
ГССПС Республики Индии в спутниковую cистему поиска и спасания "КОСПАС-САРСАТ",
|
||
ОТМЕЧАЯ принятое на 29-й сессии Совета "КОСПАС-САРСАТ" решение о том, что
|
||
желательно дополнить спутниковую систему поиска и спасания "КОСПАС-САРСАТ" путем
|
||
официальной интеграции в нее системы ГССПС Республики Индии, работающей на частоте
|
||
406 МГц,
|
||
заявляют о нижеследующем:
|
||

||
ОПРЕДЕЛЕНИЯ
|
||
- "Соглашение" означает Соглашение о Международной программе "КОСПАС-
|
||
САРСАТ";
|
||
- "Понимание" означает настоящее Понимание между государствами-Сторонами
|
||
Соглашения и Республикой Индией о присоединении Республики Индии к
|
||
Международнай
|
||
программе
|
||
"КОСПАС-САРСАТ"
|
||
в
|
||
качестве
|
||
государства,
|
||
предоставляющего услуги ГССПС;
|
||
- "Стороны Соглашения" означает Стороны Соглашения о Международной программе
|
||
"КОСПАС-САРСАТ";
|
||
- "Программа" означает осуществляемую Сторонами Соглашения деятельность по
|
||
предоставлению, эксплуатации и координации спутниковой системы поиска и
|
||
спасания "КОСПАС-САРСАТ" в соответствии с Соглашением;
|
||
- "Система" означает спутниковую систему поиска и спасания "КОСПАС-САРСАТ",
|
||
включая:
|
||
a) низкоорбитальные
|
||
спутники
|
||
космического
|
||
сегмента
|
||
системы
|
||
НССПС
|
||
(низкоорбитальной спутниковой системы поиска и спасания), представленные в
|
||
статье 3 Соглашения;
|
||
b) геостационарные спутники космического сегмента системы ГССПС (по решению
|
||
Совета в соответствии со статьей 3.2 Соглашения);
|
||
c) наземный
|
||
сегмент,
|
||
предоставляемый
|
||
Сторонами
|
||
и
|
||
государствами,
|
||
обеспечивающими наземный сегмент, в соответствии с положениями Соглашения,
|
||
включая станции приема и обработки информации, работающие со спутниками
|
||
систем НССПС и ГССПС космического сегмента и координационными центрами
|
||
Системы;
|
||
d) радиобуи, работающие на частотах 406 МГц и 121,5 МГц, в соответствии со
|
||
cтатьей 3 Соглашения, включая радиобуи государств-пользoвателей согласно
|
||
положениям Соглашения и положениям других государств, которые используют
|
||
Систему;
|
||

- "Совет" означает Совет "КОСПАС-САРСАТ", учрежденный в соответствии с

||
- "Секретариат" означает Секретариат, учрежденный в соответствии с Соглашением;

- "государство, обеспечивающее космический сегмент" означает косударство, которое
|
||
предоставляет и эксплуатирует элементы космического сегмента в соответствии со
|
||
статьей 3 Соглашения и (или) дополнение к космическому сегменту по решению
|
||
Совета в соответствии со статьей 3.2 Соглашения;
|
||
- "государство, предоставляющее услуги ГССПС" означает государство, которое
|
||
предоставляет и эксплуатирует средства геостационарного космического сегмента и
|
||
наземного сегмента по решению Совета в соответствии со статьей 3.2 Соглашения;
|
||
- "государство, обеспечивающее наземный сегмент" означает любое государство,
|
||
которое устанавливает и эксплуатирует оборудование наземного сегмента и
|
||
пользуется Системой в соответствии со статьей 11 Соглашения;
|
||
- "государство-пользователь" означает любое государство, которое пользуется
|
||
Системой в соответствии со статьей 12 Соглашения.

2.
|
||
ЦЕЛИ И ЗАДАЧИ ПРИСОЕДИНЕНИЯ К ПРОГРАММЕ РЕСПУБЛИКИ ИНДИИ В

государства, обеспечивающего наземный сегмент, вступившем в силу 23 мая 1991 г.,
|
||
состоит в следующем:
|
||
a) внесение вклада в долговременную эксплуатацию Системы;
|
||
b) предоставление информации о бедствии и его местоположении, получаемой от
|
||
Системы, международному сообществу на недискриминационной основе для
|
||
содействия поиску и спасанию;
|
||
c) содействие
|
||
выполнению
|
||
задач
|
||
Международной
|
||
морской
|
||
организации
|
||
и
|
||
Международной организации гражданской авиации в отношении поиска и спасания
|
||
путем предоставления информации о бедствии и его местоположении;
|
||
d) сотрудничество
|
||
с
|
||
другими
|
||
национальными
|
||
службами
|
||
и
|
||
соответствующими
|
||
международными организациями по эксплуатации и координации работы Системы.
|
||
2.2
|
||
Для выполнения поставленных задач Республика Индия установила и эксплуатирует
|
||
оборудование наземного сегмента системы НССПС в соответствии с требованиями
|
||
спецификаций наземного сегмента системы НССПС и стандартов комиссионных
|
||
испытаний, одобренных Советом.
|
||
2.3
|
||
Дополнительно к указанному вкладу Республика Индия согласилась присоединиться к
|
||
Программе также в качестве государства, предоставляющего услуги ГССПС, а также:
|
||
a) внести вклад и обеспечивать на долговременной основе эксплуатацию бортового
|
||
оборудования связи, работающего на частоте 406 МГц, спутников серии ИНСАТ и
|
||
|

||
других будущих геостационарных спутников в целях обеспечения зоны обслуживания
|
||
земной поверхности, согласованной с Советом и определенной в соответствующих
|
||
документах Системы, имея в виду штатный режим работы спутников-ретрансляторов;
|
||
b) установить и эксплуатировать оборудование наземного сегмента, состоящего по
|
||
крайней мере из одной станции приема и обработки информации для надежного
|
||
получения и обработки сигналов от радиобуев "КОСПАС-САРСАТ", работающих на
|
||
частоте 406 МГц, ретранслированных космическим сегментом системы ГССПС
|
||
ИНСАТ, с целью международной маршрутизации принятых системой ГССПС
|
||
аварийных сигналов в соотвeтствии с процедурой, одобренной Соглашением;
|
||
c) рассмотреть возможность будущего расширения своего космического сегмента системы
|
||
ГССПС, имея в виду обеспечение прямого доступа к аварийным данным системы
|
||
ГССПС со стороны других операторов наземного сегмента в зоне видимости системы
|
||
ГССПС ИНСАТ.

||
3.1
|
||
Принимая во внимание наличие узкого луча линии борт-Земля геостационарного
|
||
спутника ИНСАТ и тот факт, что данная конфигурация не позволяет другим
|
||
государствам, обеспечивающим наземный сегмент, получать напрямую и обрабатывать
|
||
сигналы радиобуев, работающих на частоте 406 МГц, ретранслированных через
|
||
спутники
|
||
ИНСАТ
|
||
системы
|
||
ГССПС,
|
||
Республика
|
||
Индия
|
||
как
|
||
государство,
|
||
предоставляющее услуги ГССПС в рамках Системы, намеревается:
|
||
a) провести комиссионные испытания и эксплуатировать свой космический сегмент в
|
||
ГССПС "КОСПАС-САРСАТ" в соответствии с процедурами, одобренными Советом;
|
||
b) гарантировать при нормальных рабочих условиях целостность зоны покрытия системы
|
||
ГССПС ИНСАТ, работающей на частоте 406 МГц;
|
||
c) провести комиссионные испытания и эксплуатировать оборудование своего наземного
|
||
сегмента системы ГССПС в соответствии с процедурами и положениями, одобренными
|
||
Советом, с целью обеспечения надлежащих характеристик Системы и требуемого
|
||
наличия аварийных данных системы ГССПС;
|
||
d) гарантировать своевременную и надежную передачу аварийных данных системы
|
||
ГССПС координационным центром Системы Республики Индии в службы поиска и
|
||
спасания и (или) другие координационные центры Системы в соответствии с
|
||
одобренным планом распределения данных Системы.
|
||
3.2
|
||
Указанный в пункте 3.1 настоящего раздела вклад не меняет обязанностей Республики
|
||
Индии в качестве государства, обеспечивающего наземный сегмент, вытекающих из
|
||
присоединения Республики Индии к Программе, о чем шла речь в преамбуле и пункте
|
||
2.2 настоящего Понимания.
|
||
3.3
|
||
Настоящее Понимание не может быть интерпретировано как возложение на Республику
|
||
Индию каких-либо обязанностей сверх условий настоящего Понимания и от Республики
|
||
Индии не ожидается выполнение каких-либо новых обязательств до согласованного с
|
||
Советом определенного периода времени или принятие без предварительного на то
|
||
согласия изменений существующих обязательств Республики Индии, вытекающих из ее
|
||
ассоциированного членства в качестве государства, обеспечивающего наземный сегмент.

4.
|
||
ОРГАНИЗАЦИЯ И ПРЕДСТАВИТЕЛЬСТВО НА ЗАСЕДАНИЯХ, ПРОВОДИМЫХ
|
||
В РАМКАХ ПРОГРАММЫ
|
||
4.1
|
||
Стороны настоящего Понимания отмечают, что для эффективного выполнения своих
|
||
обязанностей в качестве государства, предоставляющего услуги ГССПС, Республика
|
||
Индия будет иметь право при необходимости посещать соответствующие заседания,
|
||
проводимые в рамках Программы, созываемые Советом, включая открытые заседания
|
||
Совета
|
||
и
|
||
его
|
||
вспомогательных
|
||
органов,
|
||
для
|
||
решения
|
||
соответствующих
|
||
административных, эксплуатационных и технических вопросов.
|
||
4.2
|
||
Управление
|
||
космических
|
||
исследований
|
||
Республики
|
||
Индии
|
||
(ИСРО)
|
||
является
|
||
организацией, назначенной Республикой Индией для реализации ее обязанностей
|
||
согласно присоединению к Программе в качестве государства, обеспечивающего
|
||
наземный сегмент. ИСРО также несет ответственность за вклад Республики Индии в
|
||
Систему в качестве государства, предоставляющего услуги ГССПС, в соответствии с
|
||
разделами 2 и 3 настоящего Понимания.
|
||
4.3
|
||
Республика Индия признает, что участие ее представителей в заседаниях, проводимых в
|
||
рамках Программы, будут осуществляться в соответствии с положениям Соглашения и
|
||
применимыми правилами процедуры, одобренными Советом.
|
||
5.
|
||
ОТВЕТСТВЕННОСТЬ
|
||
5.1
|
||
Стороны настоящего Понимания соглашаются с тем, что государства-Стороны
|
||
Соглашения, Республика Индия и другие присоединившиеся к Программе государства
|
||
не предъявляют претензий или исков друг к другу за ущерб, убытки или финансовые
|
||
потери, связанные с деятельностью или отсутствием таковой, возникшими в связи с
|
||
присоединением к Программе или использованием Системы.
|
||
5.2
|
||
Республика Индия не несeт никакой ответственности в отношении пользователей
|
||
Системы, включая Стороны Соглашения, государства, обеспечивающие космический
|
||
сегмент, государства, обеспечивающие наземный сегмент, и государства-пользователи
|
||
или какую-либо третью сторону, в частности, в отношении любой претензии за ущерб,
|
||
убытки или финансовые потери, которые могут возникнуть в результате использования
|
||
Системы.
|
||
6.
|
||
ФИНАНСОВЫЕ ВОПРОСЫ
|
||
6.1
|
||
Республика Индия в соответствии со своими национальными бюджетными процедурами
|
||
и при условии наличия выделенных средств несет полную ответственность за
|
||
финансирование всех расходов, связанных с ее вкладом в Систему, указанном в разделах
|
||
2 и 3 настоящего Понимания.
|
||
6.2
|
||
В соответствии со статьей 6 Соглашения Республика Индия готова вносить ежегодно
|
||
стандартный взнос, периодически определяемый Советом по согласованию с
|
||
присоединившимися к Программе государствами, не являющимися Сторонами
|
||
Соглашения,
|
||
и
|
||
направляемый
|
||
на
|
||
организационную,
|
||
административную
|
||
и
|
||
координационную деятельность Программы.
|
||
6.3
|
||
В соответствии со статьей 6 Соглашения общие расходы, указанные в пункте 6.2
|
||
настоящего раздела, не включают расходы, связанные с получением и передачей
|
||
аварийной информации о бедствии через космический сегмент "КОСПАС-САРСАТ",
|
||

включая средства космического сегмента системы ГССПС Республики Индии, которые
|
||

|
||
7.
|
||
ВСТУПЛЕНИЕ В СИЛУ И ПРЕКРАЩЕНИЕ ДЕЙСТВИЯ
|
||
7.1
|
||
Настоящее Понимание применяется через 30 дней после подписания его последней
|
||
Стороной.
|
||
7.2
|
||
Республика Индия может в одностороннем порядке прекратить свое участие в
|
||
Программе в качестве государства, предоставляющего услуги ГССПС, путем
|
||
уведомления через Секретариат председателя Совета о своем намерении. Прекращение
|
||
участия может быть осуществлено через 180 дней после получения Секретариатом
|
||
уведомления Республики Индии. Секретариат информирует Стороны Соглашения о
|
||
намерении Республики Индии в одностороннем порядке прекратить свое участие в
|
||
Программе в качестве государства, предоставляющего услуги ГССПС.
|
||
7.3
|
||
Республика Индия признает, что несмотря на прекращение своего участия в Программе
|
||
в соответствии с пунктом 7.2 настоящего раздела, ее вклад в космический сегмент
|
||
"КОСПАС-САРСАТ" действует до тех пор, пока настоящее Понимание не прекратит
|
||
своего действия. В этом случае взаимодействие Республики Индии с Программой и ее
|
||
вклад в качестве государства, предоставляющего услуги ГССПС, автоматически
|
||
прекращаются.
|
||
7.4
|
||
Секретариат направляет каждому из депозитариев Соглашения один экземпляр
|
||
настоящего Понимания.
|
||
Совершено в восьми подлинных экземплярах на английском, французском и русском языках,
|
||
причем все тексты имеют одинаковое содержание.
|
